Precedence, in a way, creates a third branch of law in addition to statutory law and regulatory law. This writing will specifically argue that hard stare decisis, using precedent as a deciding factor or as immutable fact, is both unconstitutional, unwise, and wrong. <p>How and why were each of these created? Who made them? Who made the pencil that you write with? And who cut the trees that went into it? And who gathered the graphite you use? Who shaped the glass that you sip from? Or the chair that you sit in? Who made the food that you eat? And who grew the plants that went into it? And who made the tractors that farmed it? And who knows how to make the gasoline that one uses to run it?</p>
<p>Do you know how to do any of this?</p>
<p>Generally, we live in a blissful state of trust. We trust that someone in society knows how to do this. And we trust that that will continue to be. I would argue, however, that the situation is actually much more fragile than we might expect. And that's because: knowledge is a lineage.</p>
